"Article 5-1-8 [New Provision]. Officers and employees of Korean ceding insurers shall not be a party to a reinsurance contract with non-licensed foreign reinsurers who engage in sales activities, such as the conclusion of contracts, solicitation and promotion of reinsurance business or brokerage of reinsurance contracts in Korea."
The effect of this provision is to prohibit Korean insurance companies from engaging in face-to-face meetings, including all marketing activities, with unlicensed foreign reinsurers in South Korea. This reinforces existing regulations in Korea regarding non-admitted business.
Our advice to the market is that, since Lloyds is not currently licensed in South Korea, Lloyds underwriters are not permitted to engage in face-to-face meetings or marketing activities with clients in South Korea.
While Lloyds is permitted to write reinsurance business (and certain exempted classes of direct insurance) on a non-admitted basis, contact between Lloyds underwriters and Korean clients must only be made on a direct basis by means of mail, telephone, fax, video conference or the internet.
